FCC U.S. Agent for Service of Process

Every applicant for FCC equipment certification must designate a U.S. agent for service of process under 47 CFR 2.911(d)(7), in force since February 6, 2023. The applicant and agent both sign a certification, and the agent accepts service at a U.S. physical address and email. US Agent Desk serves as that agent for $490 per grantee per year, covering all FCC IDs.

What the rule requires

  • A designated agent located in the United States, with a physical U.S. address and an email address. TCBs reject PO boxes and mail forwarders (KDB 986446).
  • A written certification signed by both the applicant and the agent, acknowledging that the agent accepts service of process
  • Keeping an agent for at least one year after you permanently stop marketing and importing the equipment in the U.S., or after any FCC proceeding ends, whichever is later
  • A Covered List attestation under 47 CFR 2.911(d)(5) with each application
  • Notifying the FCC through EAS within 30 days if your agent details change (47 CFR 2.929(c))

What we do, and only this

  1. Prepare your agent designation letter and Covered List attestation from fixed templates, in your language with the English version controlling. You e-sign; you get PDFs and instructions for your TCB.
  2. Accept service of process and FCC correspondence at our Texas office and fcc@usagentdesk.com, log each item with a timestamp, and forward it to you within 1 business day with a translation.
  3. Ask you to acknowledge each item, remind you until you do, and escalate to a person after 1 business day.
  4. Check FCC grant records, the Covered List and FCC enforcement news for your Grantee Code daily, and show it in your portal.

We are not your importer, responsible party or "liable party", not a TCB or test lab, and we give no legal advice. We screen every client against the OFAC SDN list and the FCC Covered List and decline covered entities and equipment.

Questions

Who needs an FCC U.S. agent for service of process?
Every applicant for FCC equipment certification must designate one under 47 CFR 2.911(d)(7). Applicants outside the U.S. must name a U.S.-located agent; U.S. applicants may designate themselves.
Does one letter cover all my FCC IDs?
Generally yes. TCBs accept a grantee-wide designation covering all applications under your Grantee Code. Confirm with your TCB.
How long must I keep an agent?
At least one year after you permanently stop marketing and importing the equipment in the U.S., or after any FCC proceeding involving it ends, whichever is later.
Are you our "liable party"?
No. The FCC has proposed a U.S.-based liable party (FCC 26-50, 91 FR 51139); that is a proposal, and we never offer that role. Ask your U.S. importer or distributor.
Are you a TCB or test lab?
No. We do not test, certify or review technical compliance, and we give no legal advice. We never sell "FCC certificates".
